I am aware that Red Canyon Reserve (RCR) is located in a remote part of New Mexico, and is approximately one hour by automobile from both Socorro and Truth or Consequences. There is no electrical or phone service at RCR, and the nearest neighbor is approximately five miles away over a rough road. Cell phone service can be intermittent. Facilities at RCR are primitive, and geared toward visitors who are largely or entirely self-sufficient.
The local terrain is rugged and potentially dangerous, especially near the canyon and its cliffs. The wildlife known to be present at RCR can pose dangers to humans, and includes black widow spiders, rattlesnakes, javelina, bear, large ungulates (deer and elk), and mountain lions.
The weather at RCR can also be extreme, and often features high winds and extreme temperatures.
Because most of these dangers cannot be eliminated or controlled, every visitor must be aware of the hazards, and must be prepared to take reasonable actions to protect themselves. Those persons who cannot protect themselves should either stay away from RCR, or visit it when they are accompanied by authorized agents of Quivira Coalition.
I understand that during my visit to Red Canyon Reserve (RCR), Socorro County, New Mexico, I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent to the property and infrastructure. These inherent risks include, but are not limited to, the dangers of serious personal injury, property damage, and death (“Injuries and Damages”) from exposure to the hazards inherent to the RCR property. The Quivira Coalition has not tried to contradict or minimize my understanding of these risks.
I know that injuries and damages can occur by natural causes or activities of other persons, animals, instructors and assistants or third parties, either as a result of negligence or because of other reasons. I understand that risks of such injuries and damages are involved in volunteer work days and general RCR visitation times and I appreciate that I may have to exercise extra care for my own person and for others around me in the face of such hazards.
I further understand that there may not be rescue or medical facilities or expertise necessary to deal with the Injuries and Damages to which I may be exposed. In consideration for my acceptance as a RCR visitor or workshop participant, I confirm my understanding that:
I have read any rules and conditions applicable to a workshop or a RCR visit made available to me;
This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.
To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE AND RELEASE FROM LIABILITY, its officers, directors, employees, agents, and coordinators, in any way connected with a workshop or RCR visit.
I further agree to HOLD HARMLESS the Quivira Coalition, its officers, directors, employees, agents, and coordinators from any claims, damages, injuries or losses that I may sustain while a participant in a RCR workshop or visit. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me during a RCR workshop or visit.
I have read this document in its entirety and freely and voluntarily assume all risks of such Injuries and Damages and notwithstanding such risks during all visits to RCR.
